Abstract
تناول الباحث في هذه الدراسة موضوع نظام العقوبة في التشريع الجزائي الفلسطيني.
وقد انحصرت الدراسة في بحث وتحليل ومقارنة قانون العقوبات الاردني رقم 16 لسنة 1960
المطبق في الضفة الغربية حتى الان، بقانون العقوبات المصري رقم 58 لسنة 1937 ، وبمشروع
قانون العقوبات الفلسطيني لسنة 2001 ، وبقانون العقوبات الفلسطيني رقم 74 لسنة 1936
المطبق في قطاع غزة.
وقد تمحورت الدراسة حول تساؤل الباحث عن مدى تطابق وتشابه النظام القانوني للتشريع
الجزائي الفلسطيني مع النظام القانوني لقانون العقوبات الاردني رقم 16 لسنة 1960 ، كالنظام
القانوني لقانون العقوبات المصري رقم 58 لسنة 1937 .
وهدفت هذه الدراسة الى تسليط الضوء على بعض النواقص والثغرات في قوانين ومشاريع قوانين
العقوبات المقارنة المشار اليها اعلاه، والمساهمة في اعداد مشروع قانون عقوبات فلسطيني على
مستوى جيد.
وقد اتبع الباحث المنهج الوصفي والتحليلي المقارن للنصوص القانونية في قوانين ومشاريع قوانين
العقوبات المشار اليها اعلاه.
وقد توصل الباحث الى عدد من النتائج والتوصيات اهمها وجوب اقرار قانون عقوبات فلسطيني
يوحد النظام العقابي في فلسطين ويحقق الاستقرار القانوني فيها.
In this Thesis the researcher discussed the Punishments System in the Palestinian Penal Law. In this Thesis, the Researcher analyzed and compared between the Jordanian Penal Law number 16, 1960 the implemented Penal Law in the West Bank until now with the Egyptian Penal Law number 58, 1937 with the Palestinian Penal Law Draft 2001, with the Palestinian Penal Law number 74, 1936 implemented in the Gaza Strip. The Thesis focused on the similarities between the Legal System of the Palestinian Penal Law with the Legal System of the Jordanian Penal Law number 16, 1960 with the Legal System of the Egyptian Penal Law number 58, 1937. The Thesis put the spot light on the gaps in the Penal Law Drafts and the Penal Laws mentioned above, In addition to contributing in drafting a Palestinian Penal Law in a good shape. The Researcher described and analyzed in a comparison the Legal articles in the Penal Laws and the Draft Penal Laws mentioned above. The Researcher concluded and reached other recommendations, one of them is to ratify a Palestinian Penal Law to unite the Penal System in Palestine and to secure the Legal situation in it.
