Abstract

This study deals with a historical research of Resolution (194) related to the right of the Palestinian refugees to return to their home, in terms of its content, importance, international attitudes towards it , in addition to discussing the possibility to apply it and the obstacles that prevent this and the possibility to make pace without applying it . The researcher used the historical method of analysis to deal with these historical issues with criticism and analysis. The most important conclusions made by the research include that UN Resolution (194) is the most important international resolution concerning the right of return of Palestinian refugees, which represents an essential and important nook for the Palestinian rights and there association with the UN resolutions, a right guaranteed by all laws and international laws. UN Resolution (194) ensures refugees' return and compensation together, which is a personal right, can not be conceded by any Palestinian political or international can concede. The positions of the world countries towards the issue of Palestinian refugees, has turned over more than one direction, built on the interests of these countries and their relations with the Palestinian people and Arab countries, and their relationships with each other about the rest of the other global issues, and that these transformations have affected, positively or negatively, and largely on the issue of refugees, especially in the corridors of the United Nations and UN Security Council. The results also showed that the Arab countries combined, practiced and is still practicing until today, a very important and direct role effect on the outcome of the decision and on the Palestinian popular and official positions towards the issue of refugees right of return and thus UN Resolution (194), where the majority of these countries seeks, building on their private interests and linkages, to influence the Palestinian position, possibilities and the Palestinian will towards this decision . The most important result was that the implementation of UN Resolution (194) is subject to work providing a condition to work to provide internal and external situations assistant to do so. The researcher presented a number of recommendations ,the most important of which is the need for Western nations to practice pressure on Israel to comply with the resolutions of international legitimacy and the need to raise the right of return through Palestinian educational , cultural, artistic, political, and economic programs, and the need to claim the Palestinian political leadership to uphold the practical implementation of Resolution (194).
